1. The agreement
By creating an account or using Anomica's shared or reseller hosting services, you agree to these terms, along with our Privacy Policy, which is incorporated here by reference. If you are using Anomica on behalf of a company, you are agreeing on its behalf too, and confirming you have the authority to do so.
2. Account eligibility
You must be at least 18 years old to create an account. The contact information you provide, name, email, and billing address, needs to be accurate and kept up to date, it's how we reach you about your account, billing, and any issues affecting your service.
3. Your account and its security
You're responsible for keeping your login credentials, API tokens, and SSH keys secure, and for anything that happens under your account. If you're on a reseller plan, this extends to actions taken by the client cPanel accounts you create, you're responsible for what your clients do within the resource pool you manage.
4. Acceptable use
- No hosting content that is illegal, hateful, or infringes on someone else's intellectual property or rights.
- No sending spam, distributing malware, or using your hosting to attack, scan, or disrupt other sites, servers, or networks.
- No activity that consumes a disproportionate share of shared server resources in a way that degrades service for other customers.
- Reseller customers are responsible for their own clients' compliance with this section, same as if the activity were their own.
We may suspend or terminate an account that violates these rules. Where the issue isn't urgent or actively harming others, we'll try to reach out first and give you a chance to fix it.
5. Reseller terms and client responsibility
Reseller customers may create, suspend, and manage client cPanel accounts within their assigned resource pool. Anomica is not a party to the agreement between a reseller and their own clients, disputes, billing, and support for client accounts are the reseller's responsibility, not ours. That said, every client account, however it was created, is still bound by the acceptable use rules in Section 4, and we may act directly on a client account if it's actively harming our infrastructure or other customers.
6. Shared hosting (non-reseller accounts)
Shared Hosting plans are intended for sites and applications you own or operate yourself. Reselling hosting access to third parties on a Shared Hosting plan isn't permitted, that's what Reseller Hosting is for, and it comes with the tools (WHM, white-label branding, package management) actually built for it.
7. Resource usage
Shared Hosting plans share underlying server resources fairly across customers on that server. Sustained, excessive CPU, memory, or I/O usage that measurably impacts other customers may result in us asking you to optimize your site or upgrade to a plan with a larger resource allocation. Reseller Hosting plans are bound by the vCPU, RAM, and storage pool listed for your tier, usage within that pool is yours to allocate across client accounts however you see fit.
8. Domains
Domain registrations and renewals are subject to the policies of the relevant domain registry in addition to these terms. Domains must be renewed to remain active and under your control, we send renewal reminders well before a domain expires, but timely renewal is your responsibility.
9. Content you provide
You keep ownership of the content, code, and data you host with us. By using the service, you grant Anomica the limited right to store, back up, transmit, and display that content solely as needed to provide hosting, backups, and support, we don't use it for anything else.
10. Anomica's content and trademarks
Our branding, documentation, marketing content, and any software we provide outside of standard open-source tools like cPanel and WHM are Anomica's property. If you're a reseller, the white-label branding you configure inside your own account, your logo, your nameservers, your support contact, is yours to present to your clients as your own.
11. Third-party products and services
Some parts of the service involve third parties: domain registries, payment processors (PayPal, Square, and Payoneer), and, if you choose to connect them, billing platforms like WHMCS or Blesta. We aren't responsible for the availability, terms, or policies of these third-party services, they're governed by their own agreements.
12. Compliance with applicable law
You're responsible for making sure your own use of the service, and the content you host, complies with the laws that apply to you and your visitors. For hosting infrastructure, Anomica generally acts as a processor of the data you or your visitors provide, you remain the party responsible for how that data is collected and used on your site.
13. Restricted regions and persons
You may not access or use the service if you're located in a country, or are otherwise a person or entity, subject to applicable trade sanctions or export restrictions.
14. Regulated data (HIPAA and similar)
Anomica's hosting services are not configured or certified to store protected health information or other specially regulated data categories out of the box. Don't store this kind of data on our services unless you've made a separate arrangement with us that specifically covers it.
15. Compatibility and backups
You're responsible for making sure your own equipment, software, and any application you run is compatible with our environment. We run automatic backups on a schedule that varies by plan (see your plan's specs for retention), but backups are a convenience, not a guarantee, you're responsible for keeping your own copies of anything you can't afford to lose.
16. Billing and payment
Plans renew automatically at the end of each billing period, monthly or annually, based on what you chose at checkout. Payment is handled off-platform: once your order is submitted and approved, we send a payment link through PayPal, Square, or Payoneer, whichever you selected, and your account activates once that payment clears. If a renewal payment fails, we'll notify you and give you a grace period to update your payment method before any service interruption. We may adjust pricing going forward, existing annual or longer commitments are honored for their current term, and we'll give at least 30 days' notice before a price change affects your renewal.
17. Coupons and promotions
Coupon codes are valid for the period and the products stated at the time they're issued, have no cash value, and can't be combined unless we say otherwise. We may limit a coupon to new customers, cap redemptions, or discontinue a promotion at any time. Using coupon codes in a way designed to abuse a promotion (creating multiple accounts to reuse a first-time-only code, for example) is a violation of these terms.
18. Money-back guarantee, cancellation, and refunds
New Shared and Reseller Hosting purchases include a 30-day money-back guarantee, cancel within 30 days of your first purchase and we'll refund it. Domain registrations and renewals are non-refundable once processed, that's a registry-level cost, not something we can reverse. You can cancel your hosting at any time from your account; your files remain available for 15 days after cancellation, after which they're permanently removed.
19. Uptime
We aim for 99.9% uptime across our hosting infrastructure. Scheduled maintenance that could affect availability is announced in advance whenever possible.
20. Disclaimer of warranties
The service is provided on an "as is" and "as available" basis. We don't warrant that it will be uninterrupted, error-free, or completely secure, no hosting provider honestly can. To the extent the law allows, we disclaim other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
21. Limitation of liability
To the extent permitted by law, Anomica's total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose, and we aren't liable for indirect, incidental, or consequential damages, including lost profits or lost data.
22. Indemnification
You agree to defend and indemnify Anomica against claims, damages, and expenses arising from your use of the service, your content, or your violation of these terms, including claims brought against us because of something a reseller's client account did.
23. Disclosure to law enforcement
We may disclose account information when we're legally required to, for example in response to a valid subpoena, court order, or similar legal process.
24. Governing law and disputes
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute that can't be resolved informally will be settled by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court where eligible. Claims must be brought individually, not as part of a class action.
25. Miscellaneous
Section headings are for convenience only and don't affect interpretation. If any provision of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver of it. You can't assign your account or these terms to someone else without our consent; we may assign ours, including to a successor in a merger or acquisition. Neither party is liable for delays caused by circumstances reasonably beyond its control. This document, together with the Privacy Policy, is the entire agreement between you and Anomica regarding the service.
26. Changes to these terms
We may update these terms from time to time. Material changes will be announced by email at least 30 days before taking effect, continuing to use the service after that point means you accept the update.
